Hello,

I'm looking to find out the legalities on volunteers working for a company that has yet to be registered as not-for-profit. Is this legal? I've heard that it isn't but just looking to do a bit more research on the subject.

Have you contacted the Charity Commission yet? They may be able to offer you some advice

There's also Law Works, who offer online pro bono advice to not for profits.

Please let us know if they are able to answer your questions.

Hello sambo182 as I understand you do not have to register with the Charity Commission, until your charity has a minimum income level. More info is here on the Charity Commission website. 

As for volunteering, there is not a lot of law which governs volunteers - so there is no required  legal form that your group/organisation needs to take before involving volunteers. Where it gets messy is when you start treating your volunteers in such a way that they might be construed as workers or employees. More info about this can be found in Volunteering England's very good publication Volunteers and the Law.
